Terms of Service

1. The Service

TraceSource provides configurable workspaces, apps, modules and forms for collecting and managing records. Depending on the customer’s plan and configuration, it may include HR, scheduling, bookkeeping, reconciliation, notifications, offline mobile drafts, device features and AI-assisted functionality.

Features may differ by platform, plan, country or customer settings. TraceSource is not legal, accounting, tax, employment, medical or other professional advice. You remain responsible for business decisions and for reviewing records, schedules, financial information and AI output before relying on them.

2. Eligibility and acceptance

These Terms form an agreement between FairTrack AB, registration number 559598-0250, and the person or organization using TraceSource. By creating an account, accepting an invitation, purchasing a subscription or using the Service, you agree to these Terms.

You must be at least 18 years old or otherwise able to enter a binding agreement in your country. If you use TraceSource for an organization, you confirm that you are authorized to bind that organization.

3. Accounts and workspaces

You must provide accurate account information, protect your credentials and promptly notify us of suspected unauthorized access. Workspace owners and administrators control invitations, roles, departments, apps, modules and access, subject to the capabilities applied by TraceSource.

A customer is responsible for its authorized users, permission choices and authority to add employees, contractors, respondents and other individuals. If an account is the only owner of a shared workspace, ownership must be transferred before that account can be deleted.

4. Customer content

Customer Content includes forms, prompts, responses, employee information, schedules, financial records, files and other material submitted to or generated within a customer workspace. The customer retains its rights in Customer Content.

You grant FairTrack AB a non-exclusive worldwide licence to host, copy, transmit, display, adapt and otherwise process Customer Content only as needed to provide, secure and support TraceSource, comply with law and follow lawful customer instructions.

You confirm that you have the rights, notices, lawful bases and consents needed for Customer Content and its processing. Customers are responsible for the design and lawful use of their forms, employment processes, schedules and records.

5. Acceptable use

You must not use TraceSource unlawfully; submit content you lack authority to process; bypass permissions, security controls, usage limits or subscription enforcement; introduce malware; disrupt or overload the Service; scrape it at harmful volume; infringe another person’s rights; or use AI features to make unlawful or solely automated high-impact decisions without appropriate authority and human review.

We may investigate suspected misuse and restrict content or access where reasonably necessary to protect users, TraceSource or third parties, comply with law or enforce these Terms. Where practicable and lawful, we will explain the reason and provide an opportunity to remedy it.

6. AI-assisted features

AI output is generated probabilistically and may be inaccurate, incomplete, biased or unsuitable. You must evaluate it and remain responsible for its use. Do not treat AI output as professional advice or as the sole basis for a significant decision about a person.

Plans may include monthly AI credits or usage limits. Credits measure access to features, are not currency and have no cash value. Usage is metered according to the plan presented at purchase.

7. Subscriptions and billing

Some features require a paid subscription. The displayed price, billing period, included usage, taxes and renewal terms form part of these Terms. Subscriptions automatically renew only when the purchase screen says so and applicable law permits.

Apple App Store or Google Play processes mobile purchases, and their payment, cancellation, refund and subscription-management rules apply. Web purchases may be processed by Polar. Deleting a TraceSource account does not automatically cancel a subscription; it must be managed through the billing provider.

Mandatory cancellation, refund, cooling-off and consumer rights remain unaffected. Eligible store purchases can be restored through the supported platform flow.

8. TraceSource technology

FairTrack AB and its licensors own TraceSource, its software, designs, documentation, trademarks and other technology, excluding Customer Content. Subject to these Terms and applicable payment, we grant you a limited, non-exclusive, non-transferable and revocable right to use TraceSource for your internal purposes.

If you provide feedback, you permit us to use it without identifying you or disclosing your confidential information.

9. Third-party services

TraceSource may interoperate with device platforms, billing providers, authentication services and customer-selected integrations. Their terms and privacy notices govern their independent services. This does not limit our responsibilities for service providers processing information on our behalf.

10. Confidentiality and security

Each party receiving non-public information from the other will use reasonable care to protect it and use it only to perform the agreement, except where disclosure is authorized or required by law.

We maintain measures intended to protect TraceSource and its users. You are responsible for configuring access, managing users and devices, protecting credentials and maintaining any exports or backups your organization requires.

11. Service operation and changes

We aim to keep TraceSource available but do not promise uninterrupted or error-free operation unless a separate signed agreement says otherwise. Maintenance, security incidents, internet conditions, provider failures and events beyond reasonable control may affect availability.

We may improve, replace or discontinue features. If a change materially reduces a paid core feature, we will provide the notice or remedy required by the applicable agreement and law.

12. Suspension, termination and deletion

You may stop using TraceSource at any time and may initiate account deletion through account settings or the public account-deletion page. Subscription cancellation is separate. A customer may remove a user’s workspace access without deleting that user’s account.

We may suspend or terminate access for material breach, non-payment, security risk, unlawful use or where required by law. Where reasonable and lawful, we will provide notice and an opportunity to cure.

After deletion, access ends and personal account information is deleted or de-identified according to the Privacy Policy. Shared workspace records remain under the customer organization’s control where it has an independent need and lawful basis to retain them.

13. Disclaimers and liability

Except for express promises in these Terms and to the maximum extent permitted by law, TraceSource is provided “as is” and “as available.” We disclaim implied warranties where the law permits. Nothing excludes warranties or consumer protections that cannot lawfully be excluded.

To the extent permitted by law, FairTrack AB is not liable for indirect, incidental, special or consequential loss, or loss of profit, revenue, goodwill or data. Nothing limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that cannot legally be limited.

14. Governing law and general terms

These Terms are governed by Swedish law. Disputes are subject to the courts of Sweden, without limiting mandatory rights or forums available to consumers under applicable law.

If a provision is unenforceable, the remainder continues. A delay in enforcement is not a waiver. We may assign these Terms in connection with a merger, reorganization or sale. We may update these Terms and will provide reasonable notice of material changes where required.

15. Mobile platforms

For iOS downloads, Apple is not a party to these Terms and is not responsible for TraceSource, support or claims except as required by Apple’s applicable terms. Apple and its subsidiaries are intended third-party beneficiaries of the mobile licence where required. Google Play’s applicable distribution and payment terms apply to Android downloads.
